After reviewing the appeal from Huawei, the Stockholm administrative court temporarily lifted the ban on Huawei and ZTE Corporation on November 9, local time.
On November 5, Huawei appealed the administrative decision adopted by the Swedish Post and Telecom Authority (PTS) on October 20, asking the Stockholm administrative court to issue a temporary injunction that immediately halts the implementation of this administrative decision and revokes the restrictive requirements regarding Huawei.
In a statement, Huawei claimed that the administrative decision of PTS had violated legal procedural requirements, failed to adequately consult and solicit opinions or provide any facts, evidence and legal justification, and it was lack of neutrality, independence and objectivity. It also pointed out that Huawei is a private company with global operations and is striving to become a contributor to Sweden's ICT industry, that the company has never had any major cybersecurity incidents in its 20 years of operation in Sweden, and that "we did not, do not, and will never pose any threats to Sweden's cybersecurity.”
Huawei said it understands the Swedish government's concerns about cybersecurity and any non-discriminatory, unbiased, fact-based cybersecurity requirements, clear and verifiable technical standards, open and transparent procedures are welcome. For this reason, Huawei is willing to fully cooperate with operators and PTS to meet their security requirements for 5G infrastructure. "We trust that the court will hear the case in a fair and impartial manner to protect and respect Huawei's legal rights and interests, as well as the rights and interests of the Swedish ICT industry and consumers," The statement expounded.
